Terms and Conditions

Last updated: October 24, 2026

Please read these Terms carefully. By visiting, browsing or using seaflowerproperty.com (the "Site"), or by contacting us through it, you agree to these Terms. If you do not agree, please do not use the Site.

1. Who we are

The Site is operated by Seaflower Property Group, LLC ("Seaflower," "we," "us"), a licensed real estate brokerage.

  • Rhode Island Broker License # REB.0018623
  • Connecticut Broker License # REB.0794486
  • 11 South Angell Street, PMB #421, Providence, RI 02906 · · info@seaflowerproperty.com
    Call

Our office line takes calls only. It does not receive text messages.

2. No relationship is formed by using the Site

Visiting the Site, sending us a message, filling out a form, calling or emailing us, or attending a showing does not, by itself, create any agency, fiduciary, brokerage, consulting, advisory or attorney-client relationship between you and Seaflower, and does not obligate either of us to anything. Seaflower owes you none of the duties of an agent or advisor unless and until a relationship is formed as described below.

Relationships are formed only by separate written agreement. Every client relationship with Seaflower, including seller listing, buyer representation, landlord leasing and Condo Association Consulting engagements, is created only by a separate written agreement signed by you and Seaflower, after you receive the agency relationship disclosures required by the state where the property is located. In Rhode Island, that is the Real Estate Sales Disclosure Regarding Real Estate Agency Relationships form. In Connecticut, it is the required agency disclosure and a written representation agreement. The terms of that separate agreement, not this Site, govern the services, duties and compensation.

Tenants and rental applicants. In rental transactions, Seaflower is typically engaged by, and represents, the landlord. Unless you and Seaflower sign a separate written agreement saying otherwise, Seaflower is not your agent and does not represent your interests. We work with tenants and applicants as a transaction facilitator: we assist with showings, applications, paperwork and communications, but we do not advocate for you or negotiate on your behalf. We owe you only the duties the law requires of every licensee, such as honesty, fair dealing and disclosure of known material facts.

Until a written agreement is in place, please do not share confidential information with us, such as the most you would pay, the least you would accept, or your negotiating position, because it may not be kept confidential. Seaflower acts as a dual agent or designated agent only with the informed, written consent of every party, as state law requires.

3. Listing and property information is not guaranteed

Property listings, sold prices, photos, rents, descriptions, maps, and any other information on the Site ("Property Information") come from sellers, landlords, public records, multiple listing services (MLS) and other third parties. Property Information is deemed reliable but is not guaranteed. It may contain errors, may be out of date, and may change or be withdrawn without notice.

Square footage, lot size, room counts and dimensions, year built, taxes and assessments, condominium fees and assessments, condominium documents and budgets, zoning and permitted uses, permits, flood zone and flood insurance, school assignments, utilities, septic and well, lead paint, mold, radon, asbestos, oil tanks, environmental conditions, and the condition of any building or system are all approximate and must be independently verified by you.

Any MLS or Internet Data Exchange (IDX) information shown on the Site is provided exclusively for consumers' personal, non-commercial use. It may not be used for any purpose other than identifying prospective properties consumers may be interested in purchasing. Any listing of another brokerage is shown with that brokerage's name. Sold listings in our Sales Portfolio show past results and are not an offer, a prediction or a guarantee of future results.

Nothing on the Site is an offer to sell or lease. An offer or lease is binding only when it is in a written agreement signed by all parties.

4. You are responsible for your own decisions

Real estate in Rhode Island and Connecticut rests largely on the principle of caveat emptor, or "buyer beware." The law places the duty to investigate a property on the person buying or renting it. You, not Seaflower, are responsible for your own investigation, decisions and results. By using the Site or our services, you agree to the following.

Buyers

  • Hire your own qualified, licensed professionals before you commit: home and building inspectors, pest, radon, lead, septic, well, mold and environmental inspectors, surveyors, appraisers, attorneys, lenders, insurance agents and tax advisors.
  • Use your inspection rights. In Rhode Island you are entitled to a 10-day inspection period unless you waive it in writing. For homes built before 1978 you have a federal right to a lead-based paint inspection opportunity. In Connecticut, the seller's Residential Property Condition Report reflects only the seller's own knowledge and is not a warranty or a substitute for inspection. Your own inspection is your protection.
  • Read every seller disclosure, lead paint disclosure, title report, survey, condominium document, budget, reserve study, meeting minutes and HOA or association rule yourself, and ask your attorney about anything you do not understand.
  • Verify financing, appraisal, insurability (including flood insurance), taxes, zoning, permits, school assignments and anything else that matters to you, directly with the lender, insurer, town or city, or school district.
  • Understand that a decision to waive or shorten an inspection, appraisal, financing or other contingency is yours alone, and you accept the risk of it.

Sellers

  • Give complete, truthful and timely disclosures as the law requires, including the Rhode Island Real Estate Disclosure form, the Connecticut Residential Property Condition Report, and federal and state lead paint disclosures.
  • Tell us about every known defect, violation, assessment, lien, encroachment or other material fact. We will rely on what you tell us, and the law may require us to pass known material facts on to buyers.
  • Keep the property insured and secure, and remove or protect valuables, weapons and medications before showings.

Landlords

  • Comply with all federal, state and local fair housing, lead paint, smoke and carbon monoxide, security deposit, habitability, rental registration and licensing laws.
  • Make your own final decision on every applicant, using lawful and consistent criteria.

Tenants

  • Inspect the unit before you sign, read the entire lease, and verify the rent, deposit, utilities, parking, pet rules and condition for yourself.
  • Provide true and complete information on any rental application.

Everyone

  • Seaflower does not give legal, tax, accounting, engineering, environmental, home inspection, appraisal, mortgage, insurance or survey advice. If you need that advice, hire a qualified professional. Any professional we mention is a suggestion only. You choose and pay for them, and Seaflower is not responsible for their work.

5. Condo Association Consulting

Condo Association Consulting services are provided only under a separate written agreement. Unless that agreement says otherwise, these services are general business guidance for the association's board. They are not legal, accounting, tax, engineering, reserve study, insurance or property management services. Seaflower does not provide property management. The board and the association are responsible for every decision they make, for following their declaration, bylaws, rules and the Rhode Island Condominium Act (R.I. Gen. Laws § 34-36.1), or the law of the state where the association is located, and for getting advice from the association's attorney, accountant, insurance agent and engineers.

6. No guarantee of results

We do not guarantee any sale, lease, price, rent, timeline, appraisal, financing approval, return on investment, or outcome of any negotiation or association matter. Estimates, opinions of value and market commentary are opinions only, are not appraisals, and must not be relied on as one.

7. Wire fraud warning

Criminals target real estate transactions with fake emails and texts that look like they come from agents, attorneys and title companies. Seaflower will never send you wiring instructions or ask you to change them by email or text. Before you wire or send any money, call the closing attorney or title company at a phone number you have independently verified. Seaflower is not responsible for funds you send based on instructions you did not verify by phone.

8. Fair housing

Seaflower is committed to equal housing opportunity. We do not discriminate on the basis of race, color, religion, sex, sexual orientation, gender identity or expression, national origin or ancestry, disability, familial status, marital status, age, military or veteran status, lawful source of income (including housing vouchers and rental assistance), status as a victim of domestic abuse, or any other class protected by federal, state or local law. We will not follow an instruction from anyone that would violate fair housing laws.

9. Using the Site

You agree not to: copy, scrape, harvest or republish listings, photos or content (including by robots or automated tools); use the Site or its data for any commercial purpose without our written consent; submit false, misleading, threatening, harassing or unlawful content; impersonate anyone; interfere with the Site's security or operation; or use the Site in violation of any law.

If you send us a message, review, photo or other content, you confirm that it is true and that you have the right to share it, and you give Seaflower a non-exclusive, royalty-free license to use it to respond to you and to operate the Site. We will publish reviews or testimonials only with the writer's permission.

10. Intellectual property

The Site's design, text, logos (including the Seaflower mermaid logo), graphics and photos are owned by Seaflower or our licensors and are protected by copyright and trademark law. Some photos are licensed from third parties. You may view and print pages for your own personal, non-commercial use. Any other use requires our written permission. REALTOR® and MLS® are registered marks of the National Association of REALTORS® and are used with permission.

11. Third-party links and services

The Site may link to third-party sites and services, such as realtor.com, online rental applications, map providers and lenders. We do not control them, are not responsible for their content, accuracy, privacy or security practices, and do not endorse them. Your use of them is at your own risk and under their terms.

12. Accessibility

We want the Site to be usable by everyone. If you have trouble using any part of it, call or email info@seaflowerproperty.com, and we will help you get the information another way.

13. Disclaimer of warranties

TO THE FULLEST EXTENT ALLOWED BY LAW, THE SITE AND ALL CONTENT AND PROPERTY INFORMATION ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF ACCURACY, COMPLETENESS, TIMELINESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF VIRUSES.

14. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, SEAFLOWER AND ITS MEMBERS, MANAGERS, BROKERS, LICENSEES, EMPLOYEES, AGENTS AND CONTRACTORS (THE "SEAFLOWER PARTIES") WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, BARGAIN, OPPORTUNITY, DATA, USE OR GOODWILL, ARISING OUT OF OR RELATED TO THE SITE, ITS CONTENT OR ANY PROPERTY INFORMATION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE SEAFLOWER PARTIES' TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100).

Liability for brokerage or consulting services is governed by the written agreement for those services. Nothing in these Terms limits liability that cannot be limited by law, including liability for our own fraud, gross negligence or willful misconduct, or any non-waivable rights you have under the Massachusetts Consumer Protection Act (M.G.L. c. 93A), the Connecticut Unfair Trade Practices Act, or the Rhode Island Deceptive Trade Practices Act.

15. Release

To the fullest extent allowed by law, you release the Seaflower Parties from all claims, known or unknown, arising out of: (a) the condition, value, size, zoning, environmental status or any other characteristic of any property; (b) any information you failed to verify independently; (c) the acts, omissions, statements or work of any seller, buyer, landlord, tenant, condominium association, other brokerage, inspector, contractor, attorney, lender, appraiser, insurer, title company or other third party; and (d) any decision you made, including a decision to waive or shorten an inspection or contingency. This release does not apply to the Seaflower Parties' own fraud, gross negligence or willful misconduct, or to rights that cannot be waived by law.

16. Indemnification

To the fullest extent allowed by law, you agree to indemnify, defend and hold harmless Seaflower Property Group, LLC and each of the Seaflower Parties from and against any and all claims, demands, actions, suits, proceedings, losses, damages, liabilities, judgments, settlements, fines, penalties, costs and expenses, including reasonable attorneys' fees, expert fees and court costs (together, "Losses"), arising out of or relating in any way to:

  1. your access to or use of the Site, its content or any Property Information;
  2. your reliance on any Property Information, estimate, opinion or statement without independently verifying it;
  3. your failure to inspect, investigate, test or verify any property, document or fact, or your decision to waive, shorten or not use any inspection, appraisal, financing or other contingency;
  4. any purchase, sale, lease, rental, financing, condominium association matter or other transaction or decision you make or enter into, whether or not Seaflower was involved;
  5. any information, statement, disclosure or omission you make or provide, including to Seaflower, any other party, or on any application or disclosure form, that is false, incomplete or misleading;
  6. your violation of any law or regulation, including fair housing, lead paint, landlord-tenant, security deposit, condominium and disclosure laws;
  7. your breach of these Terms or of any agreement with Seaflower;
  8. any content you submit to the Site or to Seaflower, including any claim that it infringes another person's rights;
  9. the acts or omissions of anyone you hire, invite or bring onto a property, or of your family members, guests, tenants, contractors or representatives; and
  10. any claim by a third party that arises from any of the above.

This indemnity applies even if a Seaflower Party is alleged to have been negligent, except to the extent a court of competent jurisdiction finally determines that the Losses were caused by that Seaflower Party's own fraud, gross negligence or willful misconduct, or where indemnity is prohibited by law. We may choose our own counsel and control the defense of any claim covered by this section, at your expense, and you agree to cooperate fully. You may not settle any claim that affects a Seaflower Party without our prior written consent. This section survives the end of your use of the Site and of any transaction.

17. Disputes, governing law and venue

These Terms are governed by the laws of the State of Rhode Island, without regard to its conflict-of-law rules, except where the law of your home state gives you protections that cannot be waived. Before filing any lawsuit, you agree to first contact us in writing and try in good faith to resolve the dispute, including through mediation if we both agree. Any lawsuit related to the Site must be brought in the state or federal courts located in Providence County, Rhode Island, and you consent to their jurisdiction. Any dispute between REALTORS® may also be subject to the arbitration and mediation procedures of the applicable Association of REALTORS®.

TO THE FULLEST EXTENT ALLOWED BY LAW, YOU AND SEAFLOWER EACH WAIVE THE RIGHT TO A JURY TRIAL AND AGREE THAT CLAIMS MAY BE BROUGHT ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS OR REPRESENTATIVE ACTION. Any claim relating to the Site must be brought within one (1) year after it arises, unless a longer period is required by law.

18. Other terms

  • Changes. We may update these Terms at any time by posting a new version on the Site with a new effective date. Your continued use of the Site after that means you accept the changes.
  • Severability. If any part of these Terms is found unenforceable, it will be enforced to the maximum extent allowed and the rest of these Terms will remain in full effect.
  • Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and Seaflower about the Site. If a signed written agreement with Seaflower conflicts with these Terms, the signed agreement controls for the services it covers.
  • No waiver. If we do not enforce a right right away, we have not waived it.
  • Assignment. You may not transfer your rights under these Terms. We may assign ours.
